Rental Procedures & Policies

RESERVATIONS


Equipment and facilities should be reserved as far in advance as possible to insure your specific needs. Orders placed after 12 noon for use the following day are subject to equipment availability. In such cases Edgewood Entertainment Ltd. (Edgewood) will inform you if additional charges are necessary in processing your order.

Minimum rental period is 1 day. Weekly rate is generally 4 times daily rate. Weekend use days are charged at the daily rate. Equipment is available, by special arrangement on a “pay as used” basis.

All orders are considered “reserved” unless otherwise specified. Should a booking conflict arise regarding equipment that you have “reserved”, we will contact you. You may then choose to “confirm” or “cancel” your order. Any “confirmed” order that is subsequently canceled will be subject to cancellation charges equal to ½ day’s rental.


CREDIT

Unless other arrangements are made, the lessee must establish an account with Edgewood to rent equipment and facilities. New customers should submit a completed credit application, allowing ample time for processing. ALL Rentals without an approved account are on a cash-in-advance basis.Payment on all accounts in NET 30 days. Interest will be charged at the rate of 2.5% per month on the unpaid balance after 30 days. The Lessee agrees to pay Edgewood’s legal and collection fees in the event of default on their account.Edgewood reserves the right to charge a security deposit to be held until equipment is returned and all fees recouped.

INSURANCE

No equipment will leave the premises of Edgewood without proof of appropriate insurance. The Lessee shall, at his/her own expense, insure for the replacement value of all rented equipment and supplies with an all-risk, all-loss policy. Insurance must cover loss occasioned by delays in transportation, storage or delivery. Prior to rental, Lessee shall evidence coverage by providing a certificate of insurance naming Edgewood Entertainment Ltd. as loss payee. This coverage must remain in full force from the time the equipment is picked up to the time the equipment is returned to Edgewood. Vehicle Insurance: Rented vehicle’s physical damage coverage shall include the perils of “Comprehensive” and “Collision”

Liability Insurance: Lessee shall name Edgewood as an additional insured on your liability insurance and your liability insurance shall be deemed primary insurance in the event of any claim or suit. Liability Insurance shall meet the following minimums: Commercial General Liability: $1,000,000 per occurrence & annual aggregate, Automobile Liability: $1,000,000 combined single limit, Foreign Liability, (if filming outside the U.S.A. or Canada); $2,000,000 per occurrence limit, Aircraft Liability, (if filming from an aircraft): $5,000,000.

Ten days notice must be given to Edgewood if insurance is to be changed or cancelled.

PICK UP & RETURNS

Equipment must be picked up and returned to Edgewood Studios, Howe Center, Unit 12B, Rutland, Vermont 05701. Out-going orders are available for pick-up between 12NOON and 5PM, Monday thru Friday. Returning orders are accepted between 8AM and 12NOON, Monday thru Friday. Orders can be picked up and returned at other times by prior agreement. Pick-ups and returns outside normal business hours may be subject to an off-hours service charge.

If you do not directly pick up and/or return the equipment at Edgewood, you are responsible for transportation to and/or from Edgewood. At your request and expense, Edgewood may arrange the shipment of the equipment to your desired location. You are responsible for all costs (transportation charges, taxes, duties, brokers fees, bonds, insurance, and any other costs) incurred during transit. Edgewood is not responsible for shipping delays once the equipment is delivered to your carrier. Edgewood will not accept collect shipments from you.

Equipment may not be shipped outside the Continental United States unless special arrangements have been made with Edgewood.

REPAIRS

IF EQUIPMENT MALFUNCTIONS OR IS DAMAGED IN ANY WAY, LESSEE MUST NOTIFY EDGEWOOD STUDIOS IMMEDIATELY. FAILURE TO NOTIFY EDGEWOOD WILL DEFAULT LESSEE ANY CREDIT OR REFUND ON SAID EQUIPMENT.



Damage due to negligence will be repaired and billed at our normal repair rates. Billing will include all parts, shipping and labor costs. Our current rates for camera repair is $185.00 per hour and for grip and electric $95.00 per hour. Damage incurred during shipping will be billed as referenced in sec. #2 above for all costs not covered by insurance.

Burned-out lamps not returned with the fixture will be billed to Lessee under all circumstances.

EDIT SUITE POLICIES

No smoking, food or drink is allowed in the edit suites.

Additional charges will be incurred if editor must go into overtime. (after 8 consecutive hours with ½ hour break for lunch)

SPECIAL USAGE CONDITIONS

Lessee must notify Edgewood if equipment or facilities are to be used under special conditions including but not limited to fire, water, sand, extreme vibration, magnetic fields, aviation, pyrotechnics, extreme humidity, and stunt work. Failure to notify Edgewood may result in additional charges and insurance liability.

CAMERA/AUDIO EQUIPMENT RENTAL POLICIES


    ALWAYS use optical flats on lenses during pyro, stunt, car mounts or potentially hazardous situations. There are no exceptions.

    Cameras are MUST have written approval before they are used in any potentially dangerous situations including but not limited to car mounts, stunts, pyro, aviation work, water work, etc.

    NO modifications of any kind may be made to Edgewood’s equipment without written approval.

    Camera bodies, lenses, and batteries and all Audio Equipment are to be brought and stored inside during downtime between shoot days. This is always critical as we are located in New England but especially so for equipment used during fall and wintertime. THIS IS OUR STRICT POLICY –IT MUST BE FOLLOWED REGARDLESS OF GENERAL OPINION OR WEATHER CONDITIONS.

    It is the Lessee’s responsibility to check, clean, lubricate, and have the proper scratch, registration, collimation and other photographic tests filmed and approved BEFORE camera equipment is checked out.

    NOTE: Many Motion Picture Cameras require daily lubrication. Assistants must familiarize themselves with each cameras needs.

LIABILITY

Lessee, by signing this document is assumed to have satisfactorily inspected, or to have sent a qualified representative to do same to all equipment and facilities before commencing rental. Edgewood is not responsible for any liability, claims, cost or expenses arising from use, possession or disposition of its equipment and/or facilities.


The equipment and facilities are rented without warrant or guarantee or representation of merchantability of any kind, expressed or implied.

Edgewood makes no warranty or representation, either express or implied, as to the fitness, design or condition of, or as to the quantity or capacity of our rental equipment or facilities, nor that any of said equipment or facilities will satisfy the requirements of any law, rule, specification, or contract which provides for specific equipment or specific methods. It being agreed that all such risks, as between Edgewood and Lessee are to be borne by the Lessee at its sole risk and expense.


Lessee agrees to bear sole responsibility and full liability for the safekeeping of the rented equipment and facilities, keeping both in a state of good condition and repair, free from damage of any kind whatsoever, including any charge imposed by Edgewood for cleaning the equipment and facilities to the condition they were rented out in, and the safe return date.

In the event of loss or damage to the rental equipment or facilities as a result of any cause whatsoever, lost or stolen, whether in transit from or to Edgewood’s premises, or while in the actual or constructive possession of the Lessee, full rental charges will be incurred for the period from the scheduled end of the rental until payment for loss or repairs are complete, whichever occurs last.

Lessee represents that he/she has the necessary skill and experience to operate equipment provided by the Edgewood. Lessee agrees to and does hereby indemnify and hold harmless Edgewood from any and all claims, suits, liability, expense, damage, causes of action or judgements, including attorney’s fees, resulting from the injury or death sustained by any person or persons, including but not limited to Lessee, and subleases of Lessee,


subcontractors and their respective employees, or damage to property of any kind, including but not limited to the equipment, which injury, death, or damage arises out of or is in any way connected with the use, operation or possession of the equipment or use of the facilities by anyone during the term of the rental and until the equipment is returned to Edgewood or such facilities have been vacated, including, but not limited to the failure to repair, maintain or operate the equipment as required herein. This indemnity is meant to and does include any such injury, death or damage arising from any cause whatsoever, including, but not limited to, any alleged defect in the manufacture and design of the equipment or facilities, and any acts or omissions, willful misconduct or negligent conduct of Edgewood, whether active or passive.

Edgewood Studios is not responsible for the security of any personal property, including property left on its premises and/or while on location, and/or at locations of lodging.


PLEASE NOTE -


Lessee is responsible for all blown or damaged bulbs under all conditions and situations.



Any and all loss or damage is lessee’s responsibility after equipment is checked out.


It is the lessee’s responsibility to inspect ALL equipment and bulbs BEFORE check out.
